Welcome to GenX.art. These Terms of Service ("Terms") govern your access to and use of the GenX.art website, AI art video generation platform, and related services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully before using our Service. If you do not agree with these Terms, please do not use our Service.

Service Description

GenX.art is an AI-powered art video generation platform that allows users to:

• Upload images and transform them into artistic videos
• Create videos using various art styles (Cyberpunk, Watercolor, Oil Painting, Anime, Fluid Art)
• Generate text-to-video content
• Download and share created content

We are an independent platform that provides a user-friendly interface for AI video generation. We are not affiliated with, endorsed by, or sponsored by any underlying AI model providers.

Eligibility

You must be at least 16 years old to use our Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To access certain features, you may need to create an account. When creating an account, you agree to:

• Provide accurate and complete information
• Maintain the security of your password
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

Subscription Plans and Pricing

Available Plans

• Free Plan: Limited daily generations, 720p resolution, includes watermark
• Pro Plan: Unlimited generations, 1080p resolution, no watermark, commercial license
• Lifetime Plan: One-time payment for lifetime access with all Pro features

Pricing

Current pricing is displayed on our Pricing page. Prices are in USD and may be subject to applicable taxes. We reserve the right to modify pricing with reasonable notice.

Payment Processing

Payments are processed securely through our payment processor (Creem/Stripe). By subscribing, you authorize us to charge the applicable fees to your payment method.

Refund Policy

We want you to be satisfied with our Service. Our refund policy is as follows:

Subscription Plans (Pro Monthly/Yearly)

• 7-Day Money-Back Guarantee: If you are not satisfied with your subscription, you may request a full refund within 7 days of your initial purchase.
• Refunds are not available after the 7-day period or for renewal charges.
• To request a refund, contact us at support@genx.art.

Lifetime Plan

• 14-Day Money-Back Guarantee: Lifetime plan purchases are eligible for a full refund within 14 days of purchase.
• Refunds are not available after the 14-day period.

Processing Time

• All refund requests are processed within 3 business days.
• Refunds are issued to the original payment method.
• You will receive an email confirmation once the refund is processed.

Non-Refundable Items

• Credit packages are non-refundable once credits have been used.
• Partially used subscription periods are not eligible for pro-rated refunds.

Subscription Cancellation

You may cancel your subscription at any time:

• Through your account dashboard
• By contacting our support team at support@genx.art
• Through the customer portal provided by our payment processor

Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• You will not be charged for subsequent billing periods
• You may continue to use free tier features after cancellation

User Content and Rights

Your Content

You retain all ownership rights to the original images and content you upload to our Service. By uploading content, you represent that:

• You own the content or have the right to use it
• The content does not infringe on any third-party rights
• The content complies with our Acceptable Use Policy

License to Use Your Content

By uploading content, you grant GenX.art a worldwide, non-exclusive, royalty-free license to:

• Process your content to generate AI art videos
• Store your content for service delivery
• Display your content in your account gallery

This license terminates when you delete your content or close your account.

Generated Content Ownership

• Free Plan Users: Generated videos may be used for personal, non-commercial purposes only.
• Pro/Lifetime Users: Generated videos may be used for commercial purposes, subject to these Terms.

You own the rights to videos generated from your original content, subject to the license terms of your subscription plan.

Commercial Use License

Pro and Lifetime plan subscribers receive a commercial use license that permits:

• Use of generated videos in commercial projects
• Use in marketing materials, advertisements, and promotional content
• Use on social media platforms for business purposes
• Client work and freelance projects

The commercial license does not permit:

• Reselling or redistributing the AI service itself
• Creating competing products or services
• Mass generation for resale purposes

Acceptable Use Policy

You agree not to use our Service to:

• Create content that is illegal, harmful, threatening, abusive, or harassing
• Generate content that infringes on intellectual property rights
• Create deepfakes or misleading content intended to deceive
• Upload content containing personal data without consent
• Attempt to reverse engineer or extract our AI models
• Use automated tools to abuse the Service
• Circumvent usage limits or access restrictions
• Interfere with the Service's operation or security

We reserve the right to remove content and suspend accounts that violate this policy.

AI Technology Disclaimer

Nature of AI-Generated Content

GenX.art uses advanced artificial intelligence models to generate art videos. Please understand that:

• AI-generated results may vary based on input quality, selected styles, and model capabilities
• We cannot guarantee specific outcomes or exact reproduction of requested styles
• AI models may occasionally produce unexpected or imperfect results
• Generation times may vary based on server load and complexity

Independence Statement

GenX.art is an independent platform and is not affiliated with, endorsed by, or sponsored by any underlying AI model providers (such as Google, OpenAI, or other technology companies). We provide access to AI capabilities through our custom interface and do not represent any third-party AI services.

No Warranty on AI Output

AI-generated content is provided "as is" without warranties regarding accuracy, completeness, or fitness for a particular purpose. Users are responsible for reviewing and verifying generated content before use.

Intellectual Property

Our Intellectual Property

The GenX.art platform, including its design, features, code, and branding, is protected by intellectual property laws. You may not:

• Copy, modify, or distribute our platform
• Use our trademarks without permission
• Reverse engineer our technology

Third-Party Content

Our Service may include third-party content or integrations. Such content remains the property of its respective owners and is subject to their terms.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with reasonable notice
• Experience occasional downtime due to technical issues
• Modify or discontinue features with notice

We are not liable for any loss or damage resulting from service interruptions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of data, profits, or business opportunities
• We are not liable for third-party actions or content

Indemnification

You agree to indemnify and hold harmless GenX.art, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your content or user-generated materials
• Your violation of any third-party rights

Dispute Resolution

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Informal Resolution

Before filing any legal claim, you agree to try to resolve disputes informally by contacting us at support@genx.art. We will attempt to resolve disputes within 30 days.

Changes to Terms

We may update these Terms from time to time. Changes become effective upon posting. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or prominent notice on our website.

Termination

We may terminate or suspend your access to the Service:

• For violation of these Terms
• For fraudulent or illegal activity
• For extended periods of inactivity
• At our discretion with reasonable notice

Upon termination:

• Your right to use the Service ceases immediately
• We may delete your content after 30 days
• Provisions that should survive termination will remain in effect

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and GenX.art regarding the Service.
